Administrative Law

Administrative law governs how government bodies make decisions, and how those decisions can be challenged.

What this covers

  1. 01Challenges to administrative orders
  2. 02Show-cause notices and replies
  3. 03Statutory appeals to authorities
  4. 04Licensing decisions
  5. 05Natural justice and fair procedure

How it generally works

Public authorities must act within their legal powers, follow fair procedure and give reasons. A person affected by a decision is generally entitled to notice and a hearing.

Many statutes provide an appeal or revision to a higher authority, which should usually be used first.

Where no effective remedy exists, or the action is plainly illegal, the decision may be challenged in the High Court through a writ petition.
