Intellectual Property Law

Intellectual property law protects creations of the mind — brands, creative works, inventions and designs — and governs disputes about them.

What this covers

  1. 01Trademarks and brand protection
  2. 02Copyright
  3. 03Patents and designs
  4. 04Infringement suits and injunctions
  5. 05Licensing and assignment

How it generally works

The main laws are the Trade Marks Act, 1999, the Copyright Act, 1957, the Patents Act, 1970 and the Designs Act, 2000.

Rights are enforced through civil suits for injunctions and damages; some infringements are also criminal offences. In Delhi, the High Court has an Intellectual Property Division for many such matters.

Registration, where available, makes rights much easier to prove and enforce.
