How it generally works

Claims are made to the Motor Accident Claims Tribunal (MACT) under the Motor Vehicles Act, 1988. The police are required to report the accident to the tribunal, and the injured person or legal representatives of the deceased can also file a claim.

Compensation is assessed on factors such as age, income, dependants, medical expenses and loss of future earnings. The insurer of the vehicle is usually liable to pay.

Appeals against tribunal awards lie to the High Court.
