Domestic Violence Matters

Domestic violence proceedings provide civil remedies to a woman who faces physical, sexual, verbal, emotional or economic abuse in a domestic relationship.

What this covers

  1. 01Protection orders
  2. 02Residence orders, including the right to reside in the shared household
  3. 03Monetary relief and maintenance
  4. 04Temporary custody of children
  5. 05Compensation orders

How it generally works

These remedies are available under the Protection of Women from Domestic Violence Act, 2005. An application is made to a magistrate, often with the help of a protection officer, and the magistrate can pass interim orders quickly.

Domestic violence under the Act is defined widely and includes economic abuse, such as depriving a woman of financial resources she is entitled to.

Proceedings under this Act are separate from criminal complaints, which may also be made where an offence has been committed.
