Commercial & Business Disputes

Commercial disputes arise from trade and business dealings — supply, distribution, services, construction, franchising, joint ventures and similar arrangements.

What this covers

  1. 01Claims for unpaid invoices and price of goods or services
  2. 02Disputes over the terms and performance of commercial agreements
  3. 03Construction and infrastructure contract disputes
  4. 04Distribution, agency and franchise disputes
  5. 05Suits before commercial courts

How it generally works

The Commercial Courts Act, 2015 sets up commercial courts and commercial divisions for disputes of a specified value, currently three lakh rupees and above. These courts follow stricter timelines for pleadings and disclosure.

Unless urgent interim relief is sought, a commercial suit must ordinarily be preceded by pre-institution mediation under section 12A of that Act.

Many commercial agreements contain an arbitration clause, in which case the dispute is usually referred to arbitration rather than decided by a court.
