How it generally works
Section 89 of the Code of Civil Procedure encourages settlement of disputes outside court, and under Order XXIII a suit can be decided in terms of a lawful compromise recorded by the court.
Some criminal offences can be compounded — settled — between the parties, with or without the court's permission, depending on the offence.
A settlement should be recorded in writing and should state clearly what each party will do and when.
